This article provides an overview over the new legislation on the protection of plant varieties and farmers' rights in India with a view to its effective implementation.

It finds that the Act appears to be an effective sui generis system for intellectual property rights, and that it provides a balance between plant breeders' and farmers' rights. The authors conclude that it will affect the national food and nutrition security.
